Terms of Service

These terms govern your access to PeakClip and its video clipping, analytics, scheduling, and social publishing features.

1. Acceptance and eligibility

By creating an account or using PeakClip, you agree to these Terms and our Privacy Policy. You must be legally able to enter into this agreement and at least 13 years old, or older if your country requires a higher minimum age.

2. Your account

You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Notify PeakClip promptly if you suspect unauthorized access.

3. Your content and permissions

You retain ownership of videos, audio, text, captions, and other material you submit. You grant PeakClip a limited, worldwide license to host, copy, process, modify, and transmit that content only as needed to operate, secure, improve, and provide the features you request.

You represent that you have the rights and permissions needed to upload, process, schedule, and publish your content, including any music, images, people, trademarks, and third-party material it contains.

4. Connected platforms and publishing

When you connect YouTube, Facebook, Instagram, or another service, you authorize PeakClip to perform the actions you select on that service. You remain responsible for reviewing the account, content, caption, audience, privacy setting, and scheduled time before publishing.

By using features that interact with YouTube API Services, you also agree to the YouTube Terms of Service. Your use of Google and Meta products remains subject to their respective terms and policies. Third-party platforms may change, restrict, reject, delay, or remove content independently of PeakClip.

5. AI-assisted features

PeakClip may use automated and AI-assisted systems to identify moments, transcribe media, generate clips, or suggest titles and captions. Outputs may be inaccurate, incomplete, or unsuitable. You must review outputs before relying on or publishing them, and you are responsible for the final content.

6. Acceptable use

You may not use PeakClip to violate law or third-party rights; upload unlawful, deceptive, infringing, abusive, or malicious content; bypass platform restrictions; scrape services without authorization; distribute malware; interfere with service security; reverse engineer protected portions of the service; or publish spam or artificially manipulate engagement. You must comply with applicable platform rules, including YouTube Community Guidelines and Meta policies.

7. PeakClip intellectual property

PeakClip and its software, design, branding, and documentation are owned by us or our licensors. Except for the limited right to use the service under these Terms, no rights are transferred to you.

8. Service availability

We may modify, suspend, or discontinue features and impose reasonable usage limits. Scheduling is a best-effort feature: network failures, expired permissions, platform outages, review processes, quotas, or content restrictions can prevent or delay publication. You should verify important posts on the destination platform.

9. Suspension and termination

You may stop using PeakClip at any time and request account deletion. We may restrict or terminate access if you violate these Terms, create risk or harm, fail to pay applicable fees, or if required by law or a platform provider. Provisions that by nature should survive termination will remain effective.

10. Disclaimers and liability

To the extent permitted by law, PeakClip is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or non-infringement. We are not responsible for third-party platforms or their decisions.

To the extent permitted by law, PeakClip and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our total liability for claims relating to the service will not exceed the amount you paid PeakClip in the 12 months before the event giving rise to the claim. Rights that cannot legally be excluded remain unaffected.

11. Governing terms and changes

These Terms are governed by the laws applicable where the PeakClip operator is established, while mandatory consumer protections remain unaffected. Disputes should first be raised with us in good faith. We may update these Terms and will post the new effective date; continued use after an update means you accept the revised Terms.
